Claim is submitted without prejudice to the Organization’s position that the violation involved constitutes a major dispute under the RLA.  Claimant was assigned to the TP250 XE55 from 07/16-07/31.  Claimant was required to initiate 6/7 consecutive on duty periods between 07/18-07/24, tying up at the HT at 1500 07/24.  Per the rest requirements contained in HOS, Claimant was not rested under the Hours of Service Law to again perform service until 1500 07/27.  As a result of the HOS rest, Carrier improperly showed Claimant in an unavailable status denying payment of extra board guarantee from 0100 on 07/25 to 1500 on 07/27.  Claimant did not lay off, nor was otherwise available for service, as defined by the UP-ED GEB Agreement.  Claimant earned $3000.00.  Please allow $456.78 DIP.

Extra Board RSIA 276 Hour Cap

Claim is submitted without prejudice to the Organization’s position that the violation involved constitutes a major dispute under the RLA.  Claimant was assigned to the (Circ7 xe00) board from (mm/dd to mm/dd).  Claimant was required to amass 276 service hours for the month of (July) tying up last at (1500 hours) on (mm/dd).  Per the rest requirements contained in HOS, Claimant was not rested to again work prior to (0001hours) on (mm/dd).  As a result of the HOS rest, Carrier improperly showed Claimant in an unavailable status denying payment of extra board guarantee from (0100) on (mm/dd) to (2359) on (mm/dd).  Claimant did not lay off, nor was otherwise unavailable for service, as defined by GEB Agreement.  Claimant earned ($3000.00).  Please allow ($582.76) difference in payment.

Extra Board RSIA Bonus Day

Claimant was required to initiate 6/7 consecutive starts on calendar days between (mm/dd to mm/dd), tying up at the HT after the 6/7 start at(1500 hours) on (mm/dd). Per the rest requirements contained in HOS, was not rested under the HOS to again work until ( 0001 hours) on (mm/dd). As a result of the HOS rest, Carrier improperly showed claimant in an unavailable status denying payment of extra board guarantee bonus day. Claimant did not lay off, nor was otherwise unavailable for service, as defined by the GEB Agreement. Claimant earned ($3000.00). Please allow ($246.32) Difference in Payment.

Lodging Not Secured Within a Reasonable Time

I was called for (hh:mm) on (mm/dd/yyyy) for (train ID) in the Cheyenne to Green River pool (WX510/RE56).  I tied up at Green River on (mm/dd/yyyy) at (hh:mm).  Times and dates noted above are verified in my time slip and the Employee Federal Information section.  I waited for (transportation/clean room/room) (t0/at) the Oak Tree Inn after my tie-up.  Upon arrival at the (hotel) I received my room at (time) which is more than 1 hour after tying up.  The Oak Tree Inn provides contract lodging for the Union Pacific Railroad at Green River, WY.  The bus arrived to the off duty point of Green Rover yard office and transported me to the Oak Tree Inn at (hh/mm).  Claiming a basic day (130 miles) account lodging not properly secured within a reasonable time.

Rule 20- Terminal Work Where Yard Crews On Duty

On mm/dd/yyyy I was assigned to the CIR7 pool turn #### called on the Train-ID at 00:00 to take the train to CIR7.  At the Initial/Final terminal I was instructed by Name/Title at 00:00 to perform (give details, i.e. couple into power, give unit numbers and set over to) service not in connection of train called for, where yard crews are on duty (give job ID that was on duty if possible).  Claiming time consumed from 00:00 to 00:00 for a total of hh:mm as per Rule 20 of the UP/Eastern District.

HOS Relief

If called under train symbol auto release applies ( rule 71) , if required to wait, claim wait time ( non- service claim). Be sure to put in FRA tie up or you won’t get paid.
If called as a Zone or Multiple rule 22 applies:

RULE 22: ZONE RULE
Engineers in pool or irregular freight service may be called to make short trips and turnarounds
with the understanding that one or more turnaround trips may be started out of the same terminal and paid actual miles with a minimum of 130 miles for a day; provided,

1. that the mileage of all the trips does not exceed 130 miles,
2. that the distance run from the terminal to the turning point does not exceed 25 miles, and
3. that Engineers shall not be required to begin work on a succeeding trip out of the initial terminal after having been on duty 8 consecutive hours, except as a new day subject to the first-in, first-out rule.
